The European Commission has introduced the Omnibus Package I, aiming to simplify and reduce the administrative load of the EU Carbon Border Adjustment Mechanism (CBAM), alongside other sustainability regulations. A key proposal is the creation of a new de minimis threshold, exempting imports of CBAM-covered goods below 50 tons annually — a move expected to release about 90% of importers from compliance duties while still covering 99% of embedded emissions. However, products like electricity and hydrogen are excluded from this threshold. The update also includes measures to extend CBAM reporting deadlines and allow authorized CBAM declarants to delegate reporting tasks, though they remain liable. Adjustments to CBAM certificates, default values for third-country carbon prices, and clarified emissions boundaries are also part of the changes, alongside tighter anti-circumvention rules.
Although the Omnibus Package I offers significant relief from redundant bureaucracy, it comes amid broader EU efforts to align industrial competitiveness with decarbonization goals. The Clean Industrial Deal, presented in parallel, highlights over €100 billion to support clean manufacturing and circular economy initiatives. Yet, the CBAM review scheduled for 2025 may widen the scope to additional product categories and downstream goods, potentially bringing many businesses back under CBAM's obligations. Thus, even companies currently exempted should proactively assess their exposure and prepare for future expansions. Carbon pricing regulations like CBAM will remain a key driver of supply chain decisions and investment strategies, especially as the EU tightens its sustainability focus across sectors like steel, aluminum, and fertilizers.
